    Introduction

    Welcome to Nara! This application was created to let you create and share memories with your friends and family. This document sets out the conditions under which we agree to let you use the Nara mobile application. We reserve the right to change these terms at any time. If we make changes, you will be notified by email or by a notification in the app. The following Terms of Service (hereafter, the "Terms") form a contract between you and Nara.

    Definitions

    "Terms of Service"

    means the set of rules governing the use of Nara's services.

    "User"

    refers to any person who accesses and uses our services.

    "Account"

    means the user account created on the application.

    "Memory"

    means a set of photos, videos and text, grouped under a name, with start and end dates, a location, and an associated list of users.

    "Content"

    refers to all items, such as photos, videos, text and locations, uploaded, created and shared by the user on the application.

    "Personal Data"

    means any information that can directly or indirectly identify a natural person (e.g. name, email address, photos).

    "Services"

    includes all the features of the Nara mobile applications, our website (https://nara-app.com), and the software and systems that make the applications and our website work.

    Who can use our services?

    To access the application, you must create an account by providing the required information. You are responsible for the security of your account. If your account is compromised, please contact us immediately at [email protected].

    To use the application and the services it offers, you must strictly use an account that you own.

    To use our services, you must:

    • Be at least 13 years old, or have permission from a legal guardian.
    • Not be barred from receiving our services under applicable law.
    • Not have had your account previously disabled for violating these Terms of Service or the law.

    Data protection and privacy

    Our Privacy Policy describes the information you share with us and how we handle it when you use our Services. By using our Services, you understand and agree that we may collect, use, store, process, share and transfer this information in the countries where we operate and with the partners that help us provide our Services.

    We comply with applicable data protection regulations, including the General Data Protection Regulation (GDPR) for our users in Europe. Our privacy policy may be updated to reflect changes in our practices or for regulatory compliance reasons. We will inform you of any significant change by email or via a notification in the app.

    Permitted content

    Our services let you share content with other users. This means certain rules must be followed when you decide to share content, since you are responsible for it. Here is the list of content that is prohibited from being shared through our services:

    Bullying, abuse and harassment:

    It is forbidden to share content intended to bully, abuse or harass third parties, whether other users or non-users.

    Child sexual exploitation:

    Child exploitation is strictly forbidden, and Nara applies zero tolerance to any content depicting or promoting the sexual exploitation of children.

    Hateful content:

    It is forbidden to share hateful content targeting individuals or organizations.

    Illegal activity:

    It is forbidden to share content that promotes or facilitates illegal activity.

    Intellectual property:

    It is forbidden to share content that infringes the intellectual property rights of others.

    Non-consensual nudity:

    Non-consensual nudity is strictly forbidden, and Nara applies zero tolerance to any content depicting or promoting non-consensual nudity.

    Private personal information:

    It is forbidden to share other people's private personal information without their consent.

    Suicide and self-harm:

    It is forbidden to share content that promotes, encourages or glorifies suicide or self-harm.

    Violent content:

    It is forbidden to share content that is threatening, or that incites, glorifies or expresses a desire for violence or harm.

    You are responsible for the Content you share through our Services, which means you must ensure you have the right to use that Content, and that it complies with applicable laws, rules, regulations and these Terms of Service.

    If you share Content that you do not have the rights to use, or that infringes laws, rules, regulations or these Terms of Service, we reserve the right to delete your account along with all data and content associated with it.

    You own the Content you share through our Services, and you grant Nara a license to use your Content.

    In exchange for our Services, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, copy, reproduce, process, adapt, edit, publish, transmit, display and distribute the content you share through our services, on any medium and through any distribution method. This license allows us to make your Content available to the rest of the world and to let others do the same.

    You acknowledge that this license includes the right for Nara to provide, promote and improve our Services, and to make shared Content available to other companies, organizations or individuals for the purposes of syndication, broadcast, distribution, promotion or publication on other media and services. These further uses by Nara, or by other companies, organizations or individuals, are carried out without any compensation.

    Fighting Child Sexual Abuse and Exploitation (CSAE)

    Nara strictly prohibits and applies zero tolerance towards any form of Child Sexual Abuse and Exploitation (CSAE), whether on the Nara mobile application, on nara-app.com, or through any other channel related to our Services.

    Any account posting, sharing or soliciting this type of content is immediately suspended or deleted, and we report such content to the relevant authorities and child protection organizations, as required by applicable law.

    Reporting unauthorized content

    We care about making our Services a space where our users can share the memories that matter to them. Any content that does not respect the rights of others, or that does not comply with applicable laws, rules and regulations or these Terms of Service, is forbidden. If you notice non-compliant Content, or if your Content has been copied in a way that infringes your intellectual property rights, you can report it to us via the report form on our website.

    Termination

    We may temporarily or permanently suspend your account and prevent you from using our services if we determine that you have shared non-compliant Content, or that you have used our Services in a way that infringes the rights of others, or that does not comply with applicable laws, rules, regulations or these Terms of Service.

    You may dispute this suspension by contacting us via our email address. To protect you, other users and our Services, we may temporarily suspend your account if we detect abnormal activity that could pose a technical or security risk to you, other users or our Services.

    We will delete your account after 2 years of inactivity. Before that happens, we will contact you so you can stop the deletion if you wish.

    You can also delete your account directly from the app settings. Deleting your account deletes all data associated with your account.

    License to use our services

    Our Services are protected by copyright, trademarks, trade secrets and other laws worldwide. As tempting as it might be, nothing in this User Agreement gives you the right to use the Nara name or any other trademark, logo, domain name, other distinctive brand feature, or other property right of Nara.

    For as long as you use our Services, Nara grants you a personal, worldwide, royalty-free, non-transferable and non-exclusive license to use the software provided to you as part of our Services. This license is granted solely to let you use and enjoy our Services in accordance with these Terms of Service. This license ends when you stop using our Services.

    Governing law and jurisdiction

    To the extent these Terms allow you and Nara to bring a claim in court, you and Nara agree to the exclusive jurisdiction of the courts of Paris and to French law. You and Nara agree that any claim and dispute (contractual or otherwise) arising out of or relating to these Terms of Service shall be brought exclusively before the courts of Paris, France, and shall be governed by French law, unless prohibited by the laws of the country in which you reside.
